Terms, privacy and cookies.

We help your firm avoid the common pitfalls that lose tenders. We never promise that you will win one.

Terms of service

These terms are an agreement between Tendakazi Systems Limited (“Tendakazi”, “we”) and the firm that opens an account (“your firm”, “you”), and every person who uses the platform on its behalf. By creating an account, accepting an invitation or ordering a service you agree to them.

1. What we promise, and what we do not

We do not promise that you will win any tender. Awards are decided by the procuring entity and its evaluation committee under the Public Procurement and Asset Disposal Act, 2015, its regulations and the tender document. No one outside that process can influence it, and we never claim to.

What we do is help your firm avoid the common, avoidable reasons bids fail: missed deadlines, expired or missing statutory documents, requirements overlooked in the tender document, unsigned or incomplete forms, wrong bid security, arithmetic and pricing errors, late or misdirected submission, and addenda not acted on. We do this with software, with our analysts, quantity surveyors and delivery team, and with partners.

Readiness scores, “Should you bid?” scores, price comparisons and analysis reports are guides drawn from the tender document, your records and published award data. They are not a forecast of the outcome.

2. The service

Tendakazi provides:

  • Software: a compliance vault with expiry reminders, tender and bid workspaces, matched tender alerts, calendars, contracts and invoices, supplier lists, reports and an assistant.
  • Expert services we perform or arrange: tender analysis, bill of quantities pricing, financial and technical proposals, bid compilation, printing and binding, delivery to the tender box, online submission support, statutory registrations and renewals, accounting, training and others listed in the catalogue.
  • Partner services we arrange but do not provide: bid and performance bonds, guarantees, insurance, financing and legal services, delivered by licensed insurers, banks, lenders and advocates on their own terms.
  • Public information: open tenders, buyer pages and award data published by government portals and other public sources.

3. Accounts, firms and roles

  • You must be at least 18 and authorised to act for the firm you register. The details you give about the firm must be true.
  • The person who creates the firm is its owner. Owners and administrators decide who joins and with which role; each role sees and does only what that role allows. You are responsible for everything done under your firm's account.
  • Keep passwords private and use two-factor sign-in where your firm requires it. Tell us at once if you suspect misuse.
  • An invitation link lets the invited person create their account and join your firm. Share it only with that person.

4. Your responsibilities

  • The tender document prevails. Our analysis, AI drafts, checklists and reminders support your own reading of the tender document and the procuring entity's instructions; where they differ, the tender document and the entity's instructions govern.
  • Your documents are genuine. Everything you upload or submit must be authentic, valid and yours to use. We will not prepare, alter or submit any document we believe to be forged, altered or misleading, and may close an account that attempts it.
  • You sign and you decide. Your firm decides whether to bid and at what price, signs the Form of Tender and declarations, and remains the bidder. Where we upload a bid on a portal for you, we do so as your agent on your instructions, and we never ask for or keep your portal password.
  • Deadlines. Closing times are shown in Nairobi time as published. Submission on time remains your responsibility, except to the extent we have accepted and been paid for a delivery or submission service, as set out in clause 6.
  • Keep your firm profile, contacts and vault current; matching and reminders depend on them.

5. Procurement integrity

You must not use Tendakazi, its people or its partners to:

  • offer, give or solicit any inducement to a procuring entity, evaluation committee member or official;
  • collude with other bidders, rig bids, share prices with competitors or submit bids designed to lose;
  • misrepresent your firm's qualifications, experience, ownership, AGPO status or capacity;
  • obtain confidential procurement information you are not entitled to.

Breach of this clause is grounds for immediate suspension without refund. We may report suspected offences to the relevant authorities where the law requires or permits.

6. Services, quotes and delivery

  • A service starts when you have accepted its quote and paid it, unless it is included in your plan. The quote states what is included, the price and the timing; it forms part of these terms for that service.
  • Included services are limited to the allowance shown for your plan in each period and do not roll over.
  • Bid packages: when you choose services for a tender and pay the quote, we open the bid on your desk and deliver the services chosen. The price of a package does not depend on the outcome of the tender.
  • Our analysts and quantity surveyors work from the documents available to us. Their reports and prices are professional opinions given with reasonable care; they are not a guarantee of compliance or of award.
  • Physical delivery: we commit to the collection and delivery window in the quote and give you a stamped receipt or photographic proof. If we fail to deliver within that window through our fault, our liability is the fee for that delivery and the cost of the printing we did for it.
  • Partner services are provided by the partner on its own terms. We pass on your request and documents and follow up, but the partner decides and is responsible for what it provides.
  • If you cancel a service before work starts, we refund what you paid less any third-party costs already incurred. Once work has started, fees for work done are not refundable.

7. Plans, fees and payment

  • Plans, allowances and features are as shown on the pricing page and in Billing at the time you subscribe. Corporate and Group plans are agreed in writing.
  • Fees are in Kenya shillings, payable by M-Pesa or another method we offer, and include or exclude VAT as stated on the invoice.
  • A plan change takes effect when its invoice is paid. Plans renew for the same period unless you change or cancel them in Billing before renewal; cancelling stops the next renewal and does not refund the current period.
  • Promotional codes apply only as stated, cannot be exchanged for cash, and may be withdrawn.
  • Referral rewards, when offered, are credited as stated in the referral programme and only for genuine referrals; self-referrals do not qualify.
  • If a payment is reversed or not made, we may suspend paid features and services until it is settled.

8. AI features

Some features use an AI model, including reading tender documents, drafting requirements, summarising addenda and the assistant. AI output can be wrong or incomplete. Tender analysis reports are reviewed by our analysts before you see them; other AI output is marked as a draft or suggestion for you to check. Your content is not used to train AI models.

9. Your content and our platform

  • Your documents, data and bids remain yours. You give us a licence to store, process and use them only to provide the service to your firm, and to share them with the people and partners you choose.
  • The platform, its software, design, analyses and reports are ours or our licensors'. You may use reports we prepare for your firm's own bids.
  • Public tender information is shown as published by its source, with attribution, and may contain errors in the original.
  • Reviews you give with consent may be published with your firm's name; you can ask us to remove them at any time.

10. Availability, suspension and closing an account

  • We work to keep the platform available but do not guarantee it will be uninterrupted. Plan your submissions with time to spare.
  • We may suspend or close an account for breach of these terms, non-payment, security risk or where the law requires.
  • You may close your firm's account at any time. You can export your data first; deletion is described in the privacy notice.

11. Liability

  • Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
  • We are not liable for the outcome of any tender, for the decisions of procuring entities, partners or authorities, or for loss of profit, contracts or opportunity.
  • Otherwise our total liability for any claim is limited to the fees you paid us in the twelve months before the claim, or, for a claim about a particular service, the fee paid for that service.
  • You are responsible for, and will indemnify us against, claims arising from documents you supply that are not genuine or not yours to use, and from breach of clause 5.

12. General

  • We may update these terms. We will tell account owners about material changes before they take effect; continuing to use the service after that is acceptance.
  • Neither party is liable for delay caused by events beyond its reasonable control, including portal outages, strikes and natural events.
  • These terms are governed by the laws of Kenya. We will first try to resolve any dispute by discussion; failing that, by mediation; failing that, in the courts of Kenya.
  • Notices to us go to Tendakazi Systems Limited, Kose Heights, Hurlingham, Nairobi, Kenya, or through Messages in the app.

3. AI and automated processing

Tender documents, addenda and questions to the assistant are sent to our AI provider to be read and answered. They are not used to train models. No decision with legal or similarly significant effect on you is made by automated means alone: analysis reports are reviewed by our analysts, and matching scores and readiness checks are guides you can see and challenge.

4. Who we share it with

We share personal data only as needed to run the service, with:

RecipientWhat and why
Hosting and database (Supabase, Vercel)All platform data, stored encrypted, to run the service
AI provider (Anthropic)Tender documents and assistant questions, to read and answer them

AuthoritiesWhere the law requires, or to protect rights and safety

We do not sell personal data.

5. Where it is stored

Our platform is hosted in the European Union (France), and some providers process data in other countries, including the United States. We transfer personal data outside Kenya only with appropriate safeguards as the Data Protection Act requires, such as contracts that oblige the provider to protect it, and only to providers whose protection we have assessed.

6. How long we keep it

  • Account and firm data: while the account is open, and deleted after you close it, except as below.
  • Financial records (invoices, payments): at least as long as Kenyan tax law requires, which is at least five years.
  • Audit and security logs: as long as needed to protect accounts and investigate misuse.
  • Alert subscriptions: until you unsubscribe or ask us to delete them.
  • Backups are overwritten on a rolling cycle; deleted data leaves them as they roll over.

7. How we protect it

Data is encrypted in transit and at rest. Each firm's data is separated by access rules enforced in the database itself, staff see only what their role needs, two-factor sign-in is available and can be required, and sensitive actions are logged. If a breach puts your personal data at risk we will notify the Office of the Data Protection Commissioner within 72 hours and tell affected people without undue delay.

8. Your rights

Under the Data Protection Act, 2019 you have the right to:

  • be informed about how your data is used (this notice);
  • access your personal data and receive a copy;
  • have inaccurate data corrected;
  • have data deleted where we no longer need it or you withdraw consent;
  • object to processing, including for marketing, and to restrict processing;
  • receive your data in a portable format;
  • not be subject to a decision based solely on automated processing that significantly affects you.

You can download your own data from Your profile and your firm's from Settings, and ask for deletion from the same screens. For anything else, write to us through Messages in the app or at the address below. We respond within the time the law sets. If you are not satisfied, you may complain to the Office of the Data Protection Commissioner (odpc.go.ke).

9. Marketing and alerts

Tender alerts, the weekly digest and onboarding messages can be turned off in Your profile → Notifications. Alert subscriptions made on a tender page are confirmed by email and every message carries an unsubscribe link. We do not buy contact lists.

10. Children

The platform is for businesses and is not directed at children. We do not knowingly collect data about anyone under 18.

2. Storage in your browser

Some preferences are kept in your browser's local storage rather than cookies: your light or dark theme, cards you have dismissed (for example the install prompt, the getting-started checklist, a review or referral prompt) and the assistant's open state. When the app is installed on a phone, a service worker stores pages for offline use. None of these leave your device.

3. Your choices

You can delete or block cookies in your browser settings. Blocking the strictly necessary cookies will stop you signing in; blocking the others does not affect how the platform works. Embedded tender widgets on other websites set no cookies.
